1. Subject matter of the contract
The 2protect GmbH offers its customers via the online shop www.schiesstrainer.ch We offer the products listed there for purchase. These General Terms and Conditions apply exclusively to all orders (General terms and conditions).
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By submitting the order via the "ORDER WITH OBLIGATION TO PAY" button, the customer makes a binding offer to conclude a purchase agreement. The purchase agreement is only concluded upon acceptance of the order by 2protect GmbH. Acceptance occurs through an order confirmation via email or at the latest upon shipment of the ordered goods.
The customer's contractual partner is 2protect GmbH.
3. Storage of the contract text
The contract text is saved after receipt of the order. The customer receives an order confirmation with the order details and the General Terms and Conditions valid at the time of the order via email or a corresponding link.
4. product range
4.1 Product information
All information regarding products, especially concerning availability, images, colors, dimensions, weights, technical data, materials or origin, is for informational purposes only and is non-binding.
4.2 Changes and errors
We reserve the right to make changes to the design and technology that do not significantly affect the product's function. We also reserve the right to correct errors, misprints, and price changes at any time. The manufacturer reserves the right to make technical modifications at any time.
Minor discrepancies between the product images and the products actually delivered do not constitute a defect.
4.3 Changes and errors
Should an ordered product be unavailable despite careful inventory management, 2protect GmbH reserves the right to cancel the order in whole or in part, or to withdraw from the contract. Any payments already made will be fully refunded to the customer. Further claims by the customer are excluded to the extent permitted by law.
5. Prices and payment terms
5.1 prices
All prices are in Swiss francs (CHF) unless otherwise stated.
Prices are subject to change at any time due to market fluctuations or exchange rate variations. The price displayed in the online shop at the time of ordering is binding.
5.2 Shipping costs
The applicable shipping costs are displayed to the customer during the order process before the order is completed and are calculated in addition to the purchase price. The shipping costs displayed in the online shop at the time of the order are definitive.
5.3 Payment terms
Orders are generally only shipped after full payment has been received.
Government agencies and public institutions can be supplied against invoice by prior arrangement. Payment is due within 30 days of the invoice date.
For registered business customers and resellers, the payment term for deliveries against invoice is 10 days from the invoice date.
2protect GmbH reserves the right to restrict or revoke deliveries against invoice at any time without giving reasons, particularly in cases of repeated payment defaults, outstanding receivables, or justified doubts about the customer's solvency. In these cases, 2protect GmbH may demand prepayment or other suitable payment methods.
If the customer defaults on a payment, 2protect GmbH is entitled to charge default interest at the statutory rate as well as reasonable reminder and collection costs. Until all outstanding claims have been settled in full, further orders may be suspended or processed only against prepayment.
6. Delivery terms
6.1 delivery
Deliveries will be made to the delivery address specified by the customer.
6.2 Delivery times
Products in stock are usually shipped within the timeframe specified in the online shop.
All delivery dates are non-binding unless they have been expressly confirmed in writing as binding.
Delivery delays due to force majeure, official orders, transport disruptions, supply bottlenecks or delayed delivery by manufacturers or suppliers do not give rise to any claim for damages or withdrawal from the contract, to the extent permitted by law.
6.3 Default in acceptance
Shipments that are not collected or are unjustifiably refused by the customer will be invoiced to the customer including the incurred shipping costs and a processing fee of CHF 40.–.
7. Retention of Title
The delivered goods remain the property of 2protect GmbH until full payment has been received.
8. Return Policy
8.1 Return period
Private customers have the right to return individual or all products of an order within 10 days of receiving the goods without giving any reason.
8.2 Voraussetzungen
The prerequisite for a return is that the respective products are returned unused, undamaged, complete (including all accessories) and – where reasonable – in the original packaging.
8.3 Refund
After receipt and inspection of the returned goods, the purchase price of the returned products will be credited or refunded. Shipping costs already paid for the original delivery will not be refunded. The customer is responsible for the return shipping costs.
8.4 exclusions
The right of return does not apply to special orders or products that are not part of the regular product range and were specially procured or manufactured at the customer's request.
9. Processing fees for returns
The following processing fees apply to returns:
- Unopened and undamaged original packaging: no processing fees
- Opened packaging or products showing signs of use: at least 10% of the purchase price, but at least CHF 10.–
- Damaged or incomplete products: Reduction in value according to the actual diminished value of the goods.
10. Warranty and Guarantee
10.1 Scope of Warranty
Unless otherwise stated, electronic products are covered by a 24-month warranty from the date of purchase against defects in materials and workmanship.
10.2 Warranty Exclusions
The warranty excludes damage resulting from:
- improper use
- natural wear and tear
- unauthorized modifications or repairs
- external influences
- lack of care or storage
Damage resulting from deep discharge or improper storage of batteries is excluded from the warranty.
10.3 Special Warranty Periods
Unless expressly stated otherwise, wear parts such as button cell batteries, O-rings, end caps and MagRails are covered by a warranty period of 30 days from the date of purchase.
10.4 Warranty claims
The customer bears the costs for sending in a warranty claim. In the case of a valid warranty claim, 2protect GmbH covers the costs of return shipping to the customer.
The statutory warranty rights remain reserved, unless they can be effectively excluded or limited.
Warranty claims must be made by presenting the proof of purchase.
11. Business customers and resellers
For the purposes of these terms and conditions, business customers are defined as companies, associations, and resellers that purchase goods in the course of their commercial or professional activities. For public authorities and institutions, the payment terms agreed upon in section 5 apply.
11.1 scope
These terms and conditions apply to business customers unless otherwise agreed in writing.
11.2 Returns
The voluntary right of return stipulated in section 8 applies exclusively to private customers. Returns from business customers are only accepted with the prior written consent of 2protect GmbH.
11.3 Defect inspection
Business customers must inspect the delivered goods immediately upon receipt and report any obvious defects in writing within 5 business days. Hidden defects must be reported in writing immediately upon discovery.
11.4 Resellers' Obligations
Personal data is processed in accordance with the applicable data protection declaration of 2protect GmbH.
Personal data will be treated confidentially and processed exclusively within the scope of contract processing and in compliance with applicable data protection regulations.

13. Liability
13.1 Limitation of Liability
The liability of 2protect GmbH is – to the extent permitted by law – limited to intent and gross negligence.
To the extent permitted by law, liability for indirect damages, consequential damages and lost profits is excluded.
Liability under mandatory legal provisions remains reserved.
13.2 Use of the products
The products must be used in accordance with the manufacturer's instructions, the user manual, and their intended purpose.
2protect GmbH is not liable for damages resulting from improper use, faulty assembly, unauthorized modifications, lack of maintenance or use of the delivered products for purposes other than those intended, to the extent permitted by law.
14. Place of jurisdiction and applicable law
Swiss law applies exclusively, excluding international private law.
The place of jurisdiction for all disputes is Zurich, unless mandatory statutory places of jurisdiction stipulate otherwise.
15. Final Provisions
Should individual provisions of these terms and conditions be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected.
2protect GmbH reserves the right to amend these Terms and Conditions at any time. The version valid at the time of the order applies.
Any side agreements or amendments must be in writing, unless the law prescribes a stricter form.
